These Terms of Service ("Terms") govern your access to and use of the EigenKub blockchain platform, website, and related services (collectively, the "Services") provided by EigenKub ("we," "us," or "our").

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Community-Built Blockchain

EIGENKUB IS A COMMUNITY-BUILT BLOCKCHAIN PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS.

EigenKub is a community-built blockchain that is not owned, operated, or controlled by any single entity. The blockchain is maintained by a distributed network of validators and developers who contribute to its development and operation.

As a community-built project, EigenKub comes with no guarantees of functionality, availability, or security. Users acknowledge that they are using the blockchain at their own risk and discretion.

No entity, individual, developer, or contributor shall be held liable for any damages or losses arising from the use of the blockchain, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Eligibility

To use our Services, you must be at least 18 years old and have the legal capacity to enter into these Terms. By using our Services, you represent and warrant that you meet these requirements.

If you are using our Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" will refer to that entity.

Use of Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal or internal business purposes.

You agree not to:

• Use our Services in any way that violates any applicable law or regulation
• Use our Services for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to gain unauthorized access to our Services or related systems or networks
• Use our Services to engage in any activity that could harm, disable, overburden, or impair our Services

• Bypass or circumvent measures we may use to prevent or restrict access to our Services

Risk Disclosure

Using the EigenKub blockchain involves various risks, including but not limited to:

• Smart Contract Risks: Smart contracts may contain bugs, vulnerabilities, or other issues that could lead to the loss of funds or other adverse consequences.
• Regulatory Risks: Blockchain technology and cryptocurrencies are subject to evolving regulatory frameworks that may impact the functionality or legality of the blockchain in certain jurisdictions.
• Market Risks: The value of cryptocurrencies, including KUB, can be highly volatile and may fluctuate significantly over short periods of time.
• Technical Risks: The blockchain may experience technical issues, including network congestion, forks, or other disruptions that could impact its functionality or availability.
• Security Risks: The blockchain may be subject to attacks, including but not limited to 51% attacks, Sybil attacks, or other security vulnerabilities.

You acknowledge and accept these risks when using the EigenKub blockchain.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND.

To the maximum extent permitted by applicable law, we specifically disclaim all warranties, whether express, implied, or statutory, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the security, reliability, timeliness, and performance of our Services
• Warranties regarding the accuracy, completeness, or reliability of any information obtained through our Services
• Warranties that our Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis
• Warranties regarding the correction of any defects or errors in our Services

You understand and agree that your use of our Services is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

If you are dissatisfied with any portion of our Services, or with any of these Terms, your sole and exclusive remedy is to discontinue using our Services.

You agree to indemnify, defend, and hold harmless EigenKub, its affiliates, and their respective officers, directors, employees, agents, and contributors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from:

• Your violation of these Terms
• Your violation of any rights of any other person or entity
• Your use or misuse of our Services

Modifications to Terms

We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes by updating the date at the top of these Terms and by maintaining a current version of the Terms at our website.

Your continued use of our Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using our Services.

Governing Law

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or our Services shall be instituted exclusively in the courts of Thailand.
